By accessing or using CollectorPursuit (the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.

CollectorPursuit is an AI-powered cross-platform marketplace listing tool that enables sellers to upload images, group items by SKU, auto-generate eBay/HipStamp/HipPostcard/HipComic listings using AI (Grok/XAI), schedule automated listing, optimize live listings, and manage inventory across multiple marketplaces.

You must be at least 18 years old to use the Service. You are responsible for maintaining the security of your account credentials and for all activity under your account.

You agree to provide accurate information when registering and to update it as necessary.

The Service uses artificial intelligence (Grok/XAI) to generate listing titles, descriptions, pricing suggestions, condition assessments, and item specifics. You acknowledge that:

• AI-generated content may contain errors, inaccuracies, or omissions.
• You are solely responsible for reviewing and verifying all AI-generated content before publishing to any marketplace.
• Pricing suggestions are estimates based on AI analysis and do not constitute financial or appraisal advice.
• You must ensure all published listings comply with the policies of the applicable marketplace (eBay, HipStamp, HipPostcard, HipComic, etc.).

You are solely responsible for ensuring that all listings created through the Service comply with:

• eBay's Seller Policies, User Agreement, and Prohibited & Restricted Items policy.
• HipStamp, HipPostcard, and HipComic seller terms of service.
• All applicable local, state, federal, and international laws and regulations.
• Accurate representation of item condition, authenticity, and all described features.

CollectorPursuit is not affiliated with, endorsed by, or an agent of eBay Inc. or the Hip marketplaces.

Access to certain features requires purchasing listing credits via Stripe. All purchases are final and non-refundable unless required by applicable law.

• Credits are consumed when listings are published or optimizations are applied.
• Unused credits do not expire but have no cash value and are non-transferable.
• We reserve the right to modify pricing at any time with reasonable notice.
• Subscription status (active, trial, paused, cancelled) affects access to certain features.

By using the Service, you consent to the collection and use of the following data:

• Account data: Email address, name, and role.
• eBay OAuth tokens: Encrypted refresh and access tokens for API authorization on your behalf.
• Marketplace API keys: Stored securely for HipStamp, HipPostcard, and HipComic integrations.
• Listing & session data: Images, item details, AI-generated content, and listing history you create within the Service.
• Usage data: Event logs, error logs, and listing activity for service improvement and debugging.
• Payment data: Processed exclusively by Stripe — we do not store card numbers or payment details.

Images are stored on Backblaze B2 and served via Cloudflare CDN. We do not sell or share your personal data with third parties except as required to operate the Service (Stripe, eBay API, xAI/Grok API, HipStamp/HipPostcard/HipComic APIs).

You may delete your account and all associated data at any time via the Account Settings page.

By uploading images to the Service, you represent that you own or have the right to use those images. Uploaded images are stored on Backblaze B2 and may be submitted to third-party AI APIs (xAI/Grok) for analysis and to eBay's image hosting infrastructure when listing.

Images associated with deleted sessions are automatically cleaned up from storage.

You retain ownership of content you upload. You grant CollectorPursuit a limited license to store, process, and transmit your content solely for the purpose of operating the Service.

The Service, including its design, code, and AI prompt systems, is the intellectual property of CollectorPursuit and may not be copied or reproduced without permission.

You agree not to:

• Use the Service to list counterfeit, illegal, or prohibited items.
• Circumvent daily listing caps or automation restrictions.
• Attempt to reverse-engineer, scrape, or abuse the Service's API or backend functions.
• Share account credentials or allow unauthorized users to access your account.
• Use the Service in any way that violates applicable law or marketplace policies.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, uninterrupted, or that AI-generated listings will be accurate, complete, or compliant with marketplace policies.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLLECTORPURSUIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability to you for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

You agree to indemnify and hold harmless CollectorPursuit and its operators from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or abuse of the Service. You may delete your account at any time via Account Settings.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will indicate the last updated date at the top of this page.

These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict of law principles.
